YOUR LEGAL RIGHTS MAY BE AFFECTED

There is a proposed Settlement in a class-action lawsuit pending against BAYADA Home Health Care, Inc. (“BAYADA” or “Defendant”), entitled Reed, et al. v. BAYADA Home Health Care, Inc., Case No. 160800491, 2016 August Term (Court of Common Pleas, Philadelphia County). The lawsuit alleges that BAYADA failed to pay its hourly paid Home Health Care Nurses (including Registered Nurses (“RNs”) and Licensed Practical Nurses (“LPNs”)), for time spent completing verbal shift reports and Honesty and Confidentiality, Infection Prevention and BAYADA University trainings.

BAYADA denies any and all wrongdoing. The Settlement is not an admission by either side; instead, the Parties agreed to the proposed Settlement to avoid the expense and risk of a trial and continued litigation.

Am I A Member Of The Settlement Class?

You may be included in the Settlement if you are a current or former employee of BAYADA Home Health Care, Inc., who worked in the Commonwealth of Pennsylvania from August 3, 2013, through September 10, 2024, as an hourly paid Home Health Care Nurse (including RNs and LPNs).

What Does The Settlement Provide?

BAYADA will pay $13.5 million into a Settlement Fund that will pay (1) money to eligible Class Members; (2) notice and administration costs; (3) payroll taxes; (4) service awards to the Class Representatives who brought the lawsuit; (5) attorneys’ fees, costs, and expenses. What Are Your Rights And Options?

Do Nothing: By doing nothing, you are bound by the Settlement, will automatically receive money from the Settlement, and give up any rights to sue Defendant separately about the same legal claims in this lawsuit. Further details for how you wish to obtain your Settlement payment are contained below.

Ask To Be Excluded: You have the right to exclude yourself (i.e., to opt out) from the Settlement no later than July 22, 2025. If you ask to be excluded, you will not share in the Settlement, but you will retain any rights to sue Defendant separately about the same legal claims in this lawsuit. Object To The Settlement: If you do not exclude yourself from the Settlement, you have the right to object to the Settlement and explain what you do not like about the Settlement. The Court will hold a hearing on August 19, 2025 to decide whether to approve the Settlement, the method for allocating the Settlement Fund to Class Members, a request for payment of attorneys’ fees of up to 35% of the Settlement Fund, plus costs and expenses, and service awards to the Class Representatives. You or your own lawyer may appear and speak at the hearing at your own expense. The Court may amend the deadlines in this notice or the hearing date (and time). Check the website below for updates.
